Terms of service

This is a translation; the Czech version prevails.

1. Introduction

These terms govern the provision and operation of the Royal photo booth and related services (photo printing, styling, props, digital gallery, photo guest book) between the provider and the customer — both consumers and businesses.

Provider: Ing. Jan Škrabal, place of business Před Obcí 363, 250 63 Nová Ves, Czech Republic, Company ID (IČO) 03341879, VAT ID CZ8410205309, sole trader registered in the Czech Trade Licence Register, registering office Městský úřad Brandýs nad Labem. Contact: info@royalphotobooth.cz, +420 605 414 960.

Any terms in a quote or contract that differ from these terms take precedence.

2. Enquiry, quote and contract

An enquiry sent via the website, by email or by phone is non-binding and is not an order. Based on it, we send a quote, which is an offer to enter into a contract. The quote states its validity, the scope of the service, date and venue, the final price including VAT and travel, payment terms, any deposit and cancellation terms.

The contract is concluded once you accept the quote by email within its validity. We will confirm your acceptance without undue delay by email, attaching the quote and these terms. If a deposit is agreed and you do not pay it within the period stated in the quote, the contract lapses and we release the date.

3. Price and payment

4. Cancellation by the customer

You may cancel your booking at any time by email. Cancellation terms, in particular whether and how much of a paid deposit is refunded, are stated in the quote. If no deposit was agreed, there is no cancellation charge.

5. Cancellation by us

If we find we cannot provide the agreed service, we will tell you without undue delay and try to arrange a comparable alternative at no extra cost. If you do not accept it or none is available, we will refund everything you paid us for the event within 14 days at the latest. Your statutory rights for breach of contract are not affected.

6. Consumer right of withdrawal

If the customer is a consumer and the contract concerns the photo booth at a wedding, celebration or other leisure event on a specifically agreed date, the consumer has no 14-day right of withdrawal under Section 1837(j) of the Czech Civil Code. This does not affect rights for defects or cancellation under clause 4. If a particular service does not meet the conditions of this exception, we will inform you of your right of withdrawal in the quote and attach a model withdrawal form.

7. Customer cooperation

The photo booth needs an area of about 3 × 3 m with a ceiling height of at least 2.2 m, room for guests and access to electricity. If any of this is not possible, please let us know in advance and we will find a solution. The customer will give us access to the venue at the agreed time for set-up and take-down.

8. Photos and guests' personal data

You receive the event photos in a digital gallery and may use them privately and for corporate and internal communication. We keep photos and galleries for 12 months after the event and then delete them.

Processing on behalf of the organiser (Art. 28 GDPR). When taking guests' photos, printing them and delivering the gallery, we process personal data on your behalf as a processor, only within the scope of this contract and for 12 months after the event. In particular, we will: process data only on your instructions; ensure confidentiality of the people handling it and appropriate security; assist you with guests' requests and with your obligations under Articles 32–36 GDPR; notify you of a personal data breach without undue delay; delete the data at the end of the period; and provide the information needed to demonstrate compliance and allow audits. We engage sub-processors (photo booth software, gallery storage) under your general authorisation given by concluding the contract; we will inform you of any change in advance and you may object. As the organiser, you are responsible for the legal basis for photography at your event and for informing your guests.

Showcasing our work. We publish photos showing recognisable people on our website or social media only with the consent of those people (for children, their legal guardian); the organiser's consent alone is not enough. Refusing does not affect the service. See our privacy policy for details.

9. Defects and complaints

If the service is defective (for example printing fails, operation is shorter or the gallery is missing), you are entitled to have the defect remedied, to substitute performance (for example delivery of the gallery or reprints) or to a reasonable price reduction; for a material defect you may withdraw from the contract. You can raise a complaint with the attendant during the event or by email to info@royalphotobooth.cz; raising it later does not in itself mean losing your rights if you could only discover the defect afterwards.

We will confirm receipt of a consumer's complaint by email with the date, description of the defect and the requested remedy. We will resolve it within 30 days, unless we agree a longer period, and confirm the date and manner of resolution or give reasons for rejecting it. If we miss the deadline, you may withdraw from the contract or ask for a reasonable price reduction.

10. Out-of-court dispute resolution and supervision

Consumers may resolve disputes out of court with the Czech Trade Inspection Authority (ČOI), Gorazdova 1969/24, 120 00 Prague 2, coi.gov.cz/informace-o-adr. ČOI also supervises compliance with consumer protection law; the registering trade licensing office is Městský úřad Brandýs nad Labem.

11. Final provisions

The contract is governed by Czech law. We may change these terms; a concluded contract is governed by the version we sent you with the confirmation.
